Social Security Tax Exemption

 

Relief is provided from the employer's share of 6.2% Social Security Tax for wages paid by employers that hire unemployed workers.  The relief applies to wages paid beginning March 18, 2010 and ending December 31, 2010. 

 

v     The total relief per employee cannot exceed $6,621.60.

v     The relief applies to wages paid to full and part-time employees.

v     The relief does not apply to the self-employment tax paid by self-employed individuals.

 

 

 

Who is a Qualified Employee?

  • Certifies by signed affidavit, under penalties of perjury, that he hasn't been employed for more than 40 hours during the 60-day period ending on the date the individual is hired. 
  • Begins employment February 4, 2010 thru December 31, 2010.
  • Is not employed to replace another employee unless that employee was separated voluntarily or for cause.  
  • Is not related to the employer or is an unrelated dependent of the employer who is a member of the employer's household. 

 

Social Security Tax Exemption does not apply for wages paid during the first calendar quarter which is due on April 30.  The 6.2% Social Security tax from March 18 - 31, 2010 on wages paid to qualified employees will be allowed as a credit against the employer's Social Security Tax due for the second quarter. 

 

Qualified employees who also qualify for the Work Opportunity Credit (employee must be certified by a state agency as a member of a targeted group) may only claim either the Social Security Tax Exemption or Work Opportunity Credit.

Tax Credit

 

For each qualified employee retained by the employer for 52 weeks by the end of the business' tax year, the employer will receive an additional business income tax credit which is the lesser of:

 

1.     $1,000 or

2.     6.2% of the retained qualified employee's wages

 

The credit will be taken on the 2011 tax return

 

Additional Futa Surtax

 

6.2% FUTA tax will apply to wages paid from Jan. 1, 2010 - June 30, 2011.  6% FUTA rate will apply to wages paid from July 1, 2011 and later years.
